Terms and Conditions of use for the Q8Aviation Extranet
Q8Aviation customers may only access, download, store and make use of their own online account information.
Persons who are not customers of Q8Aviation may not access the Q8Aviation Extranet or download, store or make use of any online account or other information contained therein. They shall not republish, retransmit, redistribute or otherwise make any such information available to any other parties or make the same available on any website, online service of bulletin board of their own or any other party of make same available in hardcopy or in any media.
By using the Q8Aviation Extranet, users are deemed to accept on behalf of themselves and their organisations these conditions and the Special Conditions set out below.
Special Conditions for the Q8Aviation Extranet
For the purpose of these Special Conditions for the Q8Aviation Extranet, the term “you” shall be deemed to refer to the legal entity defined as “Buyer” in your contract with Kuwait Petroleum International Aviation Company Ltd for Aviation Fuel Supply.
The Q8Aviation Extranet is provided subject to the Kuwait Petroleum International Aviation Company Limited General Terms and Conditions of Aviation Fuel Supply. However the following additional conditions will also apply:
We reserve the right to modify, suspend or withdraw the Q8Aviation Extranet. If we do decide to modify, withdraw or suspend the Q8Aviation Extranet we will give you as much notice as reasonably practicable.
You are responsible for the acts and omissions of all individuals authorised by you to use the Q8Aviation Extranet and you are liable for any failure by such individuals to perform or observe the terms and conditions of this Agreement. For the avoidance of doubt, this includes all individuals to whom you have granted access to, and/or activated as users of, the Q8Aviation Extranet and whom you shall, prior to their accessing the Q8Aviation Extranet make aware of these terms and conditions.
You accept responsibility for the security and proper use of all IDs and passwords used in connection with the Q8Aviation Extranet and must take all necessary steps (including changing passwords on a regular basis) to ensure that they are kept confidential, secure, used properly and not disclosed to unauthorised people.
You agree that Q8Aviation may use such data relating to your business relationship and dealings with Q8Aviation as is necessary to populate the Q8Aviation Extranet with relevant information.
Subject to, and in accordance with the terms and conditions of your Agreement with Q8Aviation, you accept full liability for all information viewed, downloaded or manipulated by you, or by anyone using your ID and password, via the Q8Aviation Extranet.
You agree to immediately inform Q8Aviation if there is any reason to believe that a user ID or password has or is likely to become known to someone not authorised to use it or is being or is likely to be used in an unauthorised way.
Q8Aviation will have no liability to you in respect of any matter arising out of or in connection with the Q8Avaition Extranet services we provide including any direct economic or financial loss arising as a consequence of your failure to comply with our requirements and guidance provided from time to time as to security measures associated with your use of the Q8Aviation Extranet including your use of passwords. In particular we draw your attention to the fact that we will not accept any responsibility and will deny any liability to you in respect of any unauthorised access to your on-line account where your nominated password has been used. Nothing in this clause will exclude or restrict the liability of Q8Aviation for fraud, death or personal injury resulting from our negligence or the negligence of our employees.
Acceptable Use
You may only use this Web site in accordance with these Terms and Conditions and for lawful and proper purposes which includes complying with all applicable laws, regulations and codes of practice within the UK or other jurisdiction from which you are accessing this Web site.
